Fact Sheet on February 24, 1996 Brothers to the Rescue Shoot down

February 24, 1996 shoot down was an act of state terrorism that blew two civilian aircraft out of the sky with air to air missiles while in international airspace after regime planned the act months beforehand with its espionage network in the United States.

FACT 2: Cuba is responsible for violating the right to life (Article I of the American Declaration of the Rights and Duties of Man) to the detriment of Carlos Costa, Pablo Morales, Mario De La Peña, and Armando Alejandre, who died as a result of the direct actions of its agents on the afternoon of 24 February 1996 while flying through international airspace.

FACT 4: In Alejandre v. Republic of Cuba, 996 F.Supp. 1239 (S.D.Fla. 1997), a federal district court awarded the families of three of the four occupants of the “ Brothers to the Rescue” planes shot down by Cuba in 1996 a total of $187.7 million in damages against Cuba.

FACT 5: WASP spy network was involved. One of the “illegal officers” (Gerardo Hernandez) was convicted of conspiracy to commit first-degree murder based on his role in the February 24, 1996, shoot-down of two unarmed civilian aircraft in international airspace by Cuban Air Force jet fighters, which resulted in the deaths of four people, three of them U.S. citizens.

FACT 6: Brothers to the Rescue had spotted and saved thousands of rafters in the Florida Straits and was engaged in such a mission on that day. The one plane that skirted the boundary briefly was the only one to return. The other two were shotdown miles away from Cuba’s boundary having never entered or touched it on that day and the planes had been in contact with the Cuban tower throughout the flight.

FACT 7: On July 26, 1996 the United Nations Security Council: "Noting that the unlawful downing of two civil aircraft on 24 February by the Cuban Air Force violated the principle that States must refrain from using weapons against airborne civil aircraft, the Security Council this afternoon condemned such use as being incompatible with the rules of customary international law "

FACT 8: Ana Belen Montes, the US intelligence community's top analyst on Cuban affairs had throughout a sixteen-year career at the Defense Intelligence Agency sent the Cuba intelligence service sensitive and secret information and helped to shape US opinion on Cuba. Investigation against her was triggered by her odd behavior before and after the Brothers to the Rescue shoot down. On September 21 2001 Ana Belen Montes was arrested and subsequently charged with Conspiracy to Commit Espionage for the government of Cuba. Montes eventually pleaded guilty to spying, and in October, 2002, she was sentenced to a 25-year prison term followed by 5 years of probation.

FACT 9: On December 27, 2010 and again in a January 19, 2011 clarification the defense of Cuban spy-master Gerardo Hernandez acknowledged that "there was overwhelming evidence that the 1996 shoot-down of two Brothers to the Rescue planes occurred in international airspace, not Cuban territory."

FACT 10: On December 17, 2014 President Barack Obama commuted Gerardo Hernandez’s two life sentences and returned him along with two other spies jailed for crimes in the United States to Cuba where they were received with a hero’s welcome in what is an immense propaganda victory for the Castro regime.

FACT 11:  Netflix settled a defamation lawsuit in brought by Jose Basulto of Brothers to the Rescue, who accused the streamer of falsely portraying him as a terrorist and drug trafficker in Olivier Assayas’ political spy thriller Wasp Network.

The Brothers to the Rescue shootdown 28 years later: Continuing the struggle for truth, justice, and memory

On February 24, 1996, at 3:21 and 3:27 PM, heat-seeking air-to-air missiles fired from a MiG-29 UB piloted by Lorenzo Alberto Peréz Peréz that destroyed the two planes the men were onboard, and killed Mario de la Peña, age 24; Carlos Costa, Pablo Morales, both 30, and Armando Alejandre Jr., 45. Mario, Carlos,Pablo and Armando were members of the humanitarian organization Brothers to the Rescue.

This was a premeditated act of state terrorism carried out by Mr. Peréz Peréz on the orders of both Fidel and Raul Castro and through the chain of command issuing the unlawful order that murdered these four men.

Cuban spies learned the flight schedules and were instructed not to fly on February 24 and, if they had to, to alert the MiGs with a motion while in flight to save them from suffering the same fate as the other planes.

Ana Belen Montes, a Cuban spy working in the Pentagon's Defense Intelligence Agency, carried out an influence operation to shift responsibility from the Cuban dictatorship, to its victims in Brothers the Rescue. 

Twenty eight years later, and we are just learning that Ambassador Manuel Roche, a high level spy for Havana, who in 1996 was the principal deputy of the U.S. Interests Section in Havana, and may have played a role in assisting the Cuban dictatorship minimize its accountability in this act of terrorism it committed against U.S. civilians in international airspace.

This was a premeditated killing over international airspace. The International Civil Aviation Organization (ICAO) concluded that the two planes "were shot down miles away from Cuba’s boundary having never entered or touched it on that day and the planes had been in contact with the Cuban tower throughout the flight."

They failed to destroy a third plane with Sylvia Iriondo, Andrés Iriondo, Jose Basulto, and Arnaldo Iglesias on board. 

There is no statue of limitations on murder and state terrorism.  There is much more in the Inter-American Commission on Human Rights report on the Brothers to the Rescue shoot down.

Over the past 28 years friends, and family have continued to demand truth, respect memory and demand justice through protests, petitions, and law suits


Family members held a silent vigil for their loved ones on February 23rd, gathering at 3:15 pm at Florida International University, with the vigil starting at 3:21pm and ending at 3:27pm. On February 22nd a vigil was held in Washington DC outside of the Embassy of Cuba.

Today at 10:30am at Opa-locka airport, where Brothers to the Rescue had their hangar, Jose Basulto, and other survivors of the February 24, 1996 shoot down will gather together to hold a vigil.

Twenty seven years ago the Cuban Liberty and Democratic Solidarity Act was signed into law

Twenty seven years ago, on March 12, 1996, President Bill Clinton signed into law the Cuban Liberty and Democratic Solidarity Act, which codified sanctions on Cuba, in response to the February 24, 1996 Brothers to the Rescue shoot down.

The shoot down was a premeditated act of state terrorism carried out by agents of the Castro dictatorship in international airspace against two civilian aircraft.

The Wasp spy network, led by Gerardo Hernandez, provided information to Havana that contributed to the murders of Armando Alejandre Jr., Carlos Costa, Mario de la Peña and Pablo Morales on February 24, 1996 when their two planes were shot down by two air to air missiles fired by a MiG-29 on Fidel and Raul Castro's orders

Defense intelligence analyst Ana Belen Montes, who spied for Castro in the Pentagon, conducted an influence operation prior to and during the  February 24, 1996 Brothers to the Rescue shoot down. This influence operation sought to direct blame away from the Castro regime, and onto the victims, drew the attention of investigators, and led to her arrest in September 2001.

Mario de la Peña, age 24; Carlos Costa, Pablo Morales, both 30, and Armando Alejandre Jr., 45 were murdered in international airspace on February 24, 1996 at 3:21pm and 3:27pm by heat-seeking air-to-air missiles launched from a MiG-29 UB piloted by Lorenzo Alberto Peréz Peréz that destroyed the two planes the men were onboard. Mario, Carlos, Pablo and Armando were members of the humanitarian organization Brothers to the Rescue.

FACT 8: Ana Belen Montes, the US intelligence community's top analyst on Cuban affairs had throughout a sixteen-year career at the Defense Intelligence Agency sent the Cuba intelligence service sensitive and secret information and helped to shape US opinion on Cuba. Investigation against her was triggered by her odd behavior before and after the Brothers to the Rescue shoot down. On September 21 2001 Ana Belen Montes was arrested and subsequently charged with Conspiracy to Commit Espionage for the government of Cuba. Montes eventually pleaded guilty to spying, and in October, 2002, she was sentenced to a 25-year prison term followed by 5 years of probation.

The "13 de Marzo" tugboat sinking, the Brothers to the Rescue shoot down, and the Oswaldo Payá and Harold Cepero killings: The importance of remembering Castroism's crimes

The importance of remembering.

Wednesday, July 13, 1994 at three in the morning three extended Cuban families set out for a better life aboard the "13 de Marzo" tugboat from Havana, Cuba and were massacred by Cuban government agents.

The most extensive international report on what took place is by the Inter-American Commission on Human Rights and is available on-line. Fifteen years later human rights defender Oswaldo Payá Sardiñas, national coordinator of the Christian Liberation Movement, reflected on what had happened:
Behind the Christ of Havana, about seven miles from the coast, "volunteers" of the Communist regime committed one of the most heinous crimes in the history of our city and of Cuba. In the morning, a group of seventy people in all, fled on a tugboat, led by the ship's own crew; none was kidnapped, or there against their will. They came out of the mouth of the Bay of Havana. They were pursued by other similar ships. When the runaway ship and its occupants stopped to surrender, the ships that had been chasing them started ramming to sink it. Meanwhile, on the deck, women with children in their arms begging for mercy, but the answer of their captors was to project high pressure water cannons against them. Some saw their children fall overboard under the murderous jets of water amid shrieks of horror. They behaved brutally until their perverse mission was fulfilled: Sink the fleeing ship and annihilate many of its occupants.
The man who denounced the "13 de Marzo" tugboat massacre would himself become a martyr of the same dictatorship along with Harold Cepero, a youth leader from the Christian Liberation Movement.
 
 
Nine years ago on July 22, 2012 on a stretch of road in Eastern Cuba, State Security agents rammed the car Oswaldo Payá Sardiñas and Harold Cepero Escalante were traveling in. Both bodies appeared later that same day.

July 13th will mark 27 years since 37 Cubans were killed for wanting to live in freedom. Eleven of them were children, and nine days later we will remember two men killed nine years ago for non-violently advocating for freedom in Cuba.

One year after the massacre on July 13, 1995, Cuban exiles gathered together and set out in a flotilla that peacefully invaded Cuban national territory to travel to the spot where the "13 de Marzo" tugboat sank and where the human remains of the 37 victims still reside never returned to their families to this day to hold religious services for them. Ramón Saúl Sánchez organized and led the flotilla aboard the boat christened "Democracia". Upon entering Cuban waters the Castro regime sent their patrol boats, helicopters, and MiGs to surround and intimidate the flotilla, but it continued until the lead boat's hull was crushed by two patrol boats, and people onboard were hurt. Responding to the attack, Brothers to the Rescue planes overflew Havana dropping leaflets that read "Comrades No. Brothers" in Spanish.  It was on that day that the Democracy Movement came into existence. It was also on that day that the Castro regime began planning its reprisal against Brothers to the Rescue, enlisting members of the WASP spy network to provide intelligence that led to the deaths of four innocents. 
 
This is how it was outlined in a legal document presented to the United States Department of Justice in Falls Church, Virginia.

On July 13, 1995, two BTTR aircraft over flew Havana. The Cuban government charged that Basulto publicly, openly and patently endeavored to provoke air incidents and violate Cuban territorial sovereignty. On that flight, Hank Tester, a news reporter from Miami, flew aboard Basulto's plane filming as "fighters were in the area." Basulto claimed his intrusion was an act of civil disobedience. (App. Exh.60) The purpose of the July 13 over-flight was to create a diversion for Cuban fighters that were at the time threatening a freedom flotilla off the territorial waters of Cuba. The flotilla in turn was lawfully commemorating the sinking of the tugboat "13 de Marzo" and the tragic loss of forty lives caused by Cuban gunboats ramming the defenseless vessel. (App. Exh.8 and 60) On July 14, 1995, the day after the over flight, the Cuban government first declared its intention to shoot down even peaceful intruders. Cuba would not govern itself by international standards of engagement when dealing with non-military intrusions.


 25 years ago on February 24, 1996 a Cuban MiG-29UB Fulcrum and a MiG-23ML intercepted three US civilian registered Cessna 337s (N2456S, N5485S and N2506), operated by the Brothers to the Rescue while they were engaged on a humanitarian search and rescue mission over the Florida Straits for Cuban rafters in international airspace.

At 3:21 pm EST the Brothers to the Rescue Cessna 337 (N2456S) was destroyed by an air-to-air missile fired by the Cuban MiG-29 military aircraft.

At 3:27 pm EST the Brothers to the Rescue Cessna 337 (N5485S) was destroyed by an air-to-air missile fired by a Cuban MiG-29 military aircraft.

Immediately killed were Armando Alejandre Jr.,45 years old, Carlos Alberto Costa, age 29, Mario Manuel de la Peña, age 24, and Pablo Morales, age 29. This was a premeditated act of state terrorism carried out by Havana on the orders of both Fidel and Raul Castro.

The third Brothers to the Rescue Cessna 337 (N2506) was able to escape and the survivors Jose Basulto, Arnaldo Iglesias, Silvia Iriondo and Andres Iriondo were able to set the record straight on the propaganda offensive already underway from Havana to misrepresent what had happened.


On Sunday, July 11th at 7:00pm free Cubans, and friends of freedom, will gather outside the Cuban Embassy in Washington DC [ 2630 16th St NW, Washington, DC 20009] for a silent vigil to remember the victims of the "13 de marzo" tugboat massacre, those murdered outside of Cuba for peacefully protesting this crime, and the martyred leader who denounced the crime inside Cuba.

On Tuesday, July 13th at  4:00pm at the Cuban Memorial located at Tamiami Park in Miami, FL [11201 SW 24 Street, Miami, FL] the community is invited to remember the "13 de marzo" tugboat sinking with survivors, relatives of the victims, and with Ramón Saúl Sánchez of the Democracy Movement. This gathering will be presided over by Kiele Alessandra, the young woman whose protest in the baseball game between Cuba and Venezuela in West Palm Beach drew international attention.  

The Castro regime has spent much in the way of resources on misinformation campaigns to cover up this history. The facts, when known, have led some who had a hard left upbringing to break with the regime.

German-born Anna Veltfort spent her formative years in Cuba and was traumatized by the  "treatment of gay people, especially starting in 1965 when [her] university was bombarded with antigay rhetoric by the government and by the UJC (the Young Communist Union)." However it was what came later that she says led to her horror with the Castro regime. "In subsequent years, her disillusionment grew as she saw 'the ever increasing militarization of daily life and of the life of the country; the Cuban government’s rejection of Glasnost (the political liberalization policies of Gorbachev in the Soviet Union); the show trial and execution of General Ochoa; and the deliberate sinking of the Tugboat “13 de marzo” in July 1994, with 70 people aboard who had hijacked the boat in their attempt to flee Cuba—37 men, women, and children drowned,' she said, in an interview with the University of Miami's UNews@TheU last month.

Truth and memory are necessary elements to change hearts, and minds to achieve positive change, but this is not the most important reason to remember. Holocaust survivor and author Elie Wiesel in his important work Night  explained the importance of remembering: "To forget would be not only dangerous but offensive; to forget the dead would be akin to killing them a second time.”

On this day Pablo Morales Barbas was born in 1966. He was murdered by the Castro regime on February 24, 1996.

Four men were killed when the two planes they were flying in were shot down on a Saturday afternoon at 3:21 and 3:27 on February 24, 1996 over international airspace while engaged in a search and rescue flight for Cuban rafters. Their planes were destroyed by air-to-air missiles fired by a Cuban MiG-29 aircraft on the orders of Raul and Fidel Castro.

Pablo Morales Barbas was born in Havana, Cuba, on May 16, 1966 and was the same age as Carlos Costa but with a different life experience. He studied cartography and obtained a degree as a geodesics technician. In August 1992, Pablo fled Cuba on a raft and after three days at sea, was spotted in the ocean by Brothers to the Rescue. This experience motivated him to join the previously mentioned organization. He was a passenger in the aircraft with Carlos Costa when they were shot down on February 24, 1996.

Pablo was survived by his mother Eva Barbas, who passed away in 2013, a sister, and a brother. He was a Cuban citizen at the time of his death with residency in the United States and was just 29 years old. He would have turned fifty five years old today.

What was Pablo doing in Brothers to the Rescue?

He risked his live in the Florida Straits to rescue Cuban rafters and at the same time the organization he belonged to, Brothers to the Rescue, challenged the Cuban exile community to abandon both violent resistance and appeasement approaches in order to embrace strategic nonviolence.  This path followed the way of Martin Luther King Jr. and Mohandas Gandhi with both civil disobedience and a constructive program. 
 
What was the end result? Brothers to the Rescue saved more than 4,200 men, women, and children ranging from a five-day old infant to a 79 year old man, and rescued thousands more during the 1994 refugee crisis. This humanitarian movement also brought together Cubans on both sides of the Florida Straits. This the Castro regime could not abide, and did all it could to destroy this grassroots movement, including murder and terrorism.

He did not die in vain and his martyrdom is remembered inside and outside of Cuba and will continue to be so wherever free Cubans gather. This is also true of the other three men who died with him on February 24, 1996.
 
 
The four who were killed represented all aspects of the Cuban diaspora: Armando Alejandre Jr, a child who arrived with his parents from Cuba in 1960, Carlos Costa, born in Miami Beach in 1966 and Mario Manuel de la Peña, born in New Jersey in 1971 the children of Cuban exiles. 
 
Pablo Morales was born in Cuba in 1966, raised there and was saved by Brothers to the Rescue when he was 26 years old while fleeing the island on a raft. Two were from Havana, one was from New Jersey and the other from Miami Beach.  

Today we remember Pablo Morales on the 55th anniversary of his birth, and the cost of nonviolent resistance that saved thousands of lives, and for the span of five years brought Cubans on both sides of the Florida Straits together.

The Brothers to the Rescue shootdown 25 years later: Continuing the struggle for truth, justice, and memory

Mario de la Peña, age 24; Carlos Costa, Pablo Morales, both 30, and Armando Alejandre Jr., 45 were murdered in international airspace on February 24, 1996 at 3:21pm and 3:27pm by heat-seeking air-to-air missiles launched from a MiG-29 UB piloted by Lorenzo Alberto Peréz Peréz that destroyed the two planes the men were onboard. Mario, Carlos, Pablo and Armando were members of the humanitarian organization Brothers to the Rescue.

This was a premeditated act of state terrorism carried out by Mr. Peréz Peréz on the orders of both Fidel and Raul Castro and through the chain of command issuing the unlawful order that killed these four men.

Cuban spies obtained the information on flight times, and were told not to fly on February 24th, and if they did have to fly to signal the MiGs with a motion while in flight to avoid the fate of the others.

This was a premeditated killing over international airspace. The International Civil Aviation Organization (ICAO) concluded that the two planes "were shot down miles away from Cuba’s boundary having never entered or touched it on that day and the planes had been in contact with the Cuban tower throughout the flight."

They failed to destroy a third plane with Sylvia Iriondo, Andrés Iriondo, Jose Basulto, and Arnaldo Iglesias on board. 

There is no statue of limitations on murder and state terrorism.  There is much more in the Inter-American Commission on Human Rights reports on the Brothers to the Rescue shoot down, and worth reading.

Over the past 25 years friends, and family have continued to demand truth, respect memory and demand justice through protests, petitions, and law suits.
